Hangry Solutions Inc. (“Hangry”, “us”, “we” or “our” as the case may be) is committed to protecting the personal information you provide. We have implemented policies and procedures in order to protect the personal information and privacy of the users of Hangry’s mobile application (the “App”). Our privacy policy explains how we handle your “Personal Information”. “Personal Information” includes your name, email address, billing address, credit card information, Hangry password, push device ID, promo codes, your order history and any and all other information you may provide directly or indirectly through the App or through our website located at gethangry.com (the “Website”) or any of its sub-domains.

1. Use

1.1. Our primary purpose in collecting Personal Information is to provide you with a safe and efficient experience when you use the App.

1.2. You agree that we may use your Personal Information to:

  • Allow you to send food and beverage orders to participating restaurants and stores through the App (the “Services”) and provide customer support you request;
  • Resolve disputes, collect fees and troubleshoot problems;
  • Enforce our Terms of Use; and
  • Administer, support, develop and improve the Services and the App.

2. Disclosure to Third Parties

2.1. General Disclosure to all Third Parties

2.1.1. We may disclose your Personal Information to respond to legal requirements, enforce our terms of use, distribute your comments or ratings of the App to visitors of the Website and prospective users of the App, or protect your, other users’ or any other third party’s safety.

2.1.2. This policy addresses only the use and disclosure of the Personal Information we collect from you. You acknowledge that, if you disclose any information to other entities through the App or Services, different rules may apply to their use or disclosure of the information you disclose to them.

2.1.3. You acknowledge that by using the App you may be redirected to a third party website. Hangry does not know or control the privacy policies of any third party you may be directed to through the App. It is your responsibility to read and accept any privacy policy of the third parties you are redirected to through the App before using their information and services.

2.2. Disclosure to Participating Restaurants

2.2.1. We will disclose your full name to each specific restaurant you submit an order to each time you submit an order. This is for the purpose of facilitating orders and for allowing you to pick up your order. We do not provide participating restaurants with your credit card information or email address.

2.3. Disclosure to Business Entities

2.3.1. We do not share your Personal Information with nor do we sell or rent your Personal Information to third parties for marketing purposes.

2.3.2. We do not share or disclose any of your credit card information, including billing address, to our partnered restaurants. We will disclose your full name with each order submission.

2.3.3. We may share your Personal Information with other business entities, should we plan to merge with or be acquired by that business entity. Should such an event occur, we will insist that the new combined entity follow this privacy policy with respect to your Personal Information. Please see Section 8.1 for more details regarding amendments to this privacy policy.

2.3.4. We may share information regarding order data such as, inter alia, time of order, items ordered and item customizations. This data will be used for accounting purposes and product improvements. We will not share any information which would identify any of our individual customers.

3. Consent

3.1. Each time you access the App, use the Services, or provide us with Personal Information by any method of communication, you consent to the collection, use and disclosure of your Personal Information by Hangry, in accordance with the terms of this privacy policy, and specifically for the purposes set out in Section 1.

3.2. You agree that Hangry may publish your first name and any submitted comment, feedback or review of the App or the Services provided to Hangry either through email, the App or the Website.

3.3. The consent to use your Personal Information for the purposes of the Services and App ends when you delete your account. However, you give Hangry permission to retain your Personal Information after the deletion of your account for the purposes of complying with law, collecting any fees, accounting and tax reporting, assisting with any investigations and enforcing our Terms of Use.

4. Ownership of Personal Information

4.1. You warrant that you own or have the rights or control over all the Personal Information you provide us and that such information is personal to you.

5. Cookies and Storage

5.1. Hangry uses cookies to store and sometimes track information about your use of the Website. In addition to improving the general layout of the Website, cookies allow us to customize the Website for each visitor’s individual preferences and compile information about site traffic and interaction both to assist in improving Hangry’s services and to assist in the administration of the App and the Services.

5.2. Hangry will store your email address and security answer on your phone so you do not have to enter in said information every time you wish to access the App. If you do not wish to have your email address and security answer stored on your phone, such information can be removed by signing out of the App under “My Account” after each use of the App.

5.3. Hangry will not store your credit card information on their servers. In fact, credit card data never touches Hangry’s servers and are stored with our credit card merchant provider in a high security system.

6. Account Protection

6.1. Your account is secured with a password. You agree to use a password that is not obvious and keep your password confidential and shall take reasonable steps to protect your password.

6.2. If you do share your password or your Personal Information with others or are imprudent with the protection of your password, you consent that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your Personal Information and may be subject to liability for representations or actions taken on your behalf.

6.3. In the event your account password has been compromised, you agree to immediately notify Hangry and take the necessary steps to change your password. Your Password can be changed under “My Account” in the App.

7. Accessing, Reviewing and Changing your Personal Information

7.1. You must promptly update your Personal Information, if it changes or is inaccurate on the “My Account” view of the App.

7.2. You acknowledge that, once you make a public posting, you may not be able to change or remove it.

7.3. You agree to the retention of your Personal Information from closed accounts in accordance with section 3.3 of this Privacy Policy.

8. General

8.1. Amendments: You agree that we may amend this Privacy Policy at any time by posting the amended terms on the Website at gethangry.com/privacy. All amended terms automatically take effect immediately. You agree that your continued use of the App or Services shall constitute acceptance of any amendments to this Privacy Policy. This Privacy Policy was last updated on January 1st, 2014.

8.2. Governing Law: Your use of the Services, the App and the Website and the data and Personal Information collected by Hangry are subject to the applicable laws of the Province of Ontario and Canada. In the event of a dispute, you and Hangry hereby attorn to the courts of the Province of Ontario.
